Elon Musk vs OpenAI Trial Begins as Jury Selection Starts in Major AI Lawsuit

In 2019, OpenAI created a for-profit arm to attract the massive capital needed to train advanced AI models. The company later formed a deep partnership with Microsoft, which has invested more than 13 billion dollars. OpenAI is now valued at around 852 billion dollars and powers ChatGPT, one of the world’s most widely used AI tools.

Musk claims this transformation turned OpenAI into a profit-driven company that prioritized commercial success and Microsoft’s interests over its original promise to humanity. In his 2024 lawsuit, he accuses OpenAI and Altman of breaching the founding charitable trust and unjustly enriching themselves by moving away from the nonprofit mission.

Musk is seeking remedies that include returning billions in profits to OpenAI’s charitable arm and making structural changes to the company. He has stated that he will not personally benefit from any damages awarded and plans to redirect any proceeds toward AI safety initiatives focused on humanity’s benefit. Fraud-related claims were recently dropped at Musk’s request to keep the focus on the core mission issues.

OpenAI defends its actions by arguing that shifting to a for-profit structure was necessary to raise the enormous funds required for cutting-edge AI research. The company also claims that Musk himself once explored commercializing AI and even proposed merging OpenAI with Tesla. OpenAI further suggests the lawsuit is a competitive move to slow them down while Musk builds his own AI company, xAI.

The trial is taking place in the U.S. District Court for the Northern District of California in Oakland, with Judge Yvonne Gonzalez Rogers presiding.

Key witnesses expected to testify include Elon Musk, Sam Altman, Greg Brockman, Microsoft CEO Satya Nadella, and several current and former OpenAI executives. Court filings have already revealed old emails, text messages, and personal notes that are likely to make the proceedings dramatic.
