Nigeria Enacts New Cybercrime Act to Strengthen Digital Security

Nigeria has taken a significant step in bolstering its cybersecurity framework with the enactment of the Cybercrime (Prohibition, Prevention, etc.) Act, 2024. The updated law aims to address emerging threats in the digital space, protect critical national information infrastructure, and promote safer online practices for individuals, businesses, and government agencies.

The Cybercrime Act 2024 repeals the earlier 2015 law, introducing more robust measures to counter cyber threats in line with global best practices. Among its major highlights are stricter penalties for offenses such as cyberstalking, identity theft, online fraud, child pornography, and the hacking of government and corporate systems.

Importantly, the Act expands the scope of cyber offenses to cover crimes involving cryptocurrencies, online financial scams, and electronic terrorism financing. It also mandates service providers and financial institutions to cooperate with law enforcement by preserving traffic data, subscriber information, and providing necessary technical assistance.

Furthermore, the 2024 Act formalizes the designation of critical national information infrastructure, empowering authorities to implement enhanced protective measures for key sectors including banking, energy, defense, healthcare, and public communication networks.

A notable addition to the new law is the establishment of a Cybercrime Advisory Council tasked with offering guidance on policies, coordinating national efforts, and assisting with the development of cybersecurity programs.

The penalties under the Cybercrime Act 2024 are significantly stiffer. Convictions for certain offenses now carry longer prison terms, hefty fines, or both. For instance, cyberstalking could attract a fine of up to ₦10 million and imprisonment for up to 10 years, depending on the gravity of the offense.

The Nigerian government has emphasized that the updated legislation is vital in securing the country’s digital economy, enhancing trust in online transactions, and safeguarding citizens’ rights in the increasingly interconnected world.

Stakeholders in the technology, financial, and communications sectors have praised the Act as a positive move toward creating a secure and resilient digital environment. However, they also called for widespread public awareness campaigns to educate citizens on the provisions of the law and their responsibilities.
