NDPC Enhances Accountability for Data Protection, Releases Guidance Notice

The Nigeria Data Protection Commission (NDPC) is taking proactive measures to uphold the rights of data subjects and foster confidence in Nigeria’s digital economy landscape.

Outlined in its Guidance Notice titled “GUIDANCE NOTICE ON THE FILING OF DATA PROTECTION COMPLIANCE AUDIT RETURNS (CAR),” the Commission urges data controllers and processors to submit compliance audit returns. Failure to comply may result in exclusion from the National Data Protection Adequacy Programme (NaDPAP) Whitelist.

Entities falling under the umbrella of data controllers and processors include banks, telecommunications companies, hospitals, schools, ICT firms, and data centers, among others.

Notably, Dr. Vincent Olatunji, the National Commissioner/CEO of NDPC, recently revealed that the Commission is conducting free induction training for designated Data Protection Officers in both public and private sectors. This initiative aims to position Nigeria competitively in the global digital economy.

The Commission also emphasizes the importance of training and onboarding agents and contractors responsible for data processing on behalf of data controllers through its portal.
