The judiciary’s role in the ongoing controversy over local government administration in Osun State has come under intense scrutiny following conflicting court rulings on the legitimacy of elected local government officials.
The crisis began when Governor Ademola Adeleke dissolved the local government councils, citing legal irregularities in the elections conducted under the previous administration of former Governor Gboyega Oyetola. This move sparked a legal battle as the affected officials challenged their removal in court.
A ruling by the Osun State High Court upheld the governor’s decision, declaring that the local government elections conducted by the Osun State Independent Electoral Commission (OSIEC) were unlawful. However, critics argue that this decision contradicts a Supreme Court ruling, which affirms that governors lack the constitutional authority to dissolve elected local government officials.

Legal experts warn that if the judiciary does not take a firm stand, it could set a dangerous precedent where state executives can arbitrarily remove elected officials, undermining democratic governance at the grassroots level.
