Falana SAN says Members of Rivers Assembly Whose Seats Were Declared Vacant Lack Proper Legal Counsel

In an interview on Channels Television’s Politics Today, Femi Falana, a prominent constitutional lawyer, said the Rivers State House of Assembly members, Femi Falana, a prominent constitutional lawyer, said the Rivers State House of Assembly members,whose seats were declared vacant did not have access to proper legal counsel.

Falana stressed that the Independent National Electoral Commission (INEC) is legally mandated to conduct elections for the positions left vacant by the lawmakers.

He highlighted that the legislators didn’t receive adequate legal guidance, emphasizing that compliance with the Supreme Court’s pronouncements is mandatory.

Falana emphasized the importance of carefully studying and adhering to court judgments, citing a recent case where 20 lawmakers who defected from the People’s Democratic Party (PDP) to the All Progressives Congress (APC) had their seats declared vacant by the court.

He upheld the existing law, noting that unless the Supreme Court revises it, the ruling stands in Nigeria. Falana endorsed the law’s aim to prevent political defections, stating that switching parties after being elected is akin to political immorality.

He stressed the necessity for individuals to contest under the new party if they choose to leave their original party, emphasizing the need for ethical political conduct.
