Court Bars VIO from Confiscating Vehicles, Imposing Fines for Road Traffic Violations in Nigeria

The Federal High Court in Abuja has ordered the Directorate of Road Services (commonly known as VIO) to immediately stop confiscating vehicles or imposing fines on Nigerians for road traffic violations.

Delivering the judgment on October 2, 2024, in case number FHC/ABJ/CS/1695/2023, Justice Nkeonye Evelyn Maha ruled that the road traffic inspectorate is not legally empowered to seize vehicles or impose severe sanctions on motorists. The ruling followed a lawsuit filed by rights attorney Abubakar Marshal of Falana and Falana Chambers and marks a significant reduction in the powers of one of the country’s most feared road traffic enforcers, bringing relief to millions of motorists.

Justice Maha stated that VIO officers “are not empowered by any law or statute to stop, impound, confiscate the vehicles of motorists and or impose fines on motorists.” Subsequently, the court issued a perpetual injunction restraining the VIO, its agents, and any affiliates from violating the rights of Nigerians to freedom of movement, presumption of innocence, and the right to own property without lawful justification.

The ruling, however, did not apply to the Federal Road Safety Corps (FRSC), which remains the largest body of road traffic marshals in Nigeria.

It is unclear whether the VIO will comply with the ruling, as a spokesperson for the directorate did not immediately respond to requests for comments on Thursday afternoon.
